Virtual Office Website (VOW) Terms of Use

Access to our VOW is a service we provide as part of a real estate brokerage relationship, not an open public data feed. Before we display VOW-class information to you, we may require account registration, confirmation of your email address, confirmation of your telephone number, acceptance of these VOW Terms, a statement of your real estate purpose, and periodic reconfirmation of any of the above.

We may add, change, limit, or withdraw VOW features at any time, and we may apply different levels of access to different users based on verification status, applicable rules, or our own assessment of the account.

The VOW is available only to individuals who have a genuine consumer interest in Ontario real estate, that is, people who are considering buying, selling, leasing, or renting property, or who otherwise have a legitimate personal real estate purpose that we recognize.

To qualify and remain qualified, you agree that:

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Credentials are personal to you and may not be shared, sold, transferred, or used by anyone else. Notify us promptly if you believe your account has been accessed without your authorization.

Information made available through the VOW is provided solely for your own personal, non-commercial real estate research and for the purposes of your brokerage relationship with IRep Realty Inc. You may view and print VOW information for that purpose only.

You agree that you will not:

Listing content and related data made available through the VOW may be the property of, or licensed by, PropTx, the Toronto Regional Real Estate Board, the Canadian Real Estate Association, other real estate boards and associations, listing brokerages, listing salespersons, sellers, and other licensors. Nothing in these VOW Terms transfers any ownership interest or licence to you.

We make VOW content available under data licence agreements, board rules, and association policies that bind both IRep Realty Inc. and our registered users. Where those rules and these VOW Terms differ, the governing rules of the applicable board, association, or data provider prevail.

Trademarks, including MLS®, Multiple Listing Service®, REALTOR®, and associated logos, remain the property of their respective owners and are used under licence.

VOW information is compiled from sources we consider reliable, but it is not guaranteed by IRep Realty Inc. Listing status, availability, prices, taxes, fees, measurements, lot sizes, room dimensions, zoning, photographs, descriptions, market statistics, estimates, and historical records may be incomplete, delayed, superseded, corrected, suppressed, or removed without notice.

VOW information is not an appraisal, a valuation, a home inspection, or legal, tax, accounting, or financing advice. Do not rely on it as the sole basis for any real estate decision. Independent verification and professional advice are your responsibility, and we encourage you to speak with us before acting on anything you see.

Sold prices, leased rates, listing history, comparable sales, and related valuation information are VOW-class data. Where required, we display this information only to registered users who have satisfied our eligibility and verification requirements.

Visitors who are not signed in, and automated search engine crawlers, see only our public pages. Those public pages do not include VOW-only sold or leased price information.

Access to restricted information may be recorded and reviewed. We may present a limited preview, withhold figures, apply noindex directives to pages, or require you to reconfirm your eligibility where this is necessary under law, board or association policy, seller instructions, data provider requirements, or our own judgment as a brokerage.

Sellers, landlords, listing brokerages, boards, associations, and data providers may direct that certain listings or listing details not be displayed publicly, not be displayed on VOWs, or not be displayed at all.

We honour those instructions. Where an instruction, rule, or policy restricts display, we will gate, withhold, suppress, remove, or noindex the affected content as required. Where the correct treatment is unclear, we take the more restrictive approach until the position is confirmed.

To protect listing data, honour our obligations to boards and data providers, and keep the VOW secure, we may record and review account registration and verification details, sign-in activity, search and viewing patterns, report generation, request volumes and frequency, device and network signals, and security events.

Automated, excessive, anomalous, or plainly non-consumer usage may result in rate limiting, temporary suspension, permanent revocation of access, notification to the relevant board, association, or data provider, and any other step required of us. We may be obliged to produce access records to a board, association, or data provider on request.

We may suspend, limit, or terminate your VOW access at any time, with or without notice, including where registration information is inaccurate or incomplete, where a genuine real estate interest is absent, where credentials are shared, where scraping or redistribution is detected, where account activity raises security or compliance concerns, or where a seller instruction, board rule, association policy, data provider requirement, or legal obligation requires it.

You may stop using the VOW and ask us to close your account at any time. Certain registration, access, audit, brokerage, and compliance records are retained after closure as described in our Privacy Policy and as required by law and by our data licence obligations.

Personal information collected through VOW registration and use is handled for registration, identity and contact verification, security, audit and compliance, brokerage service, and customer support purposes, as described in our Privacy Policy. Our collection, use, and disclosure of personal information is subject to the Personal Information Protection and Electronic Documents Act and other applicable Canadian privacy legislation.

We may revise these VOW Terms from time to time. Revisions take effect when posted, or on the effective date stated in the revised version. Continued use of the VOW after a revision means you accept the revised VOW Terms. Where a change is material, we will make reasonable efforts to notify registered users.

To the fullest extent permitted by law, IRep Realty Inc., its brokers, salespersons, employees, and suppliers are not liable for any loss or damage arising from your use of, or reliance on, VOW information, or from any interruption, error, omission, delay, or unavailability of the VOW. Nothing in these VOW Terms limits any obligation we owe you under the Trust in Real Estate Services Act, 2002 or the rules of the Real Estate Council of Ontario.

These VOW Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario. The courts of Ontario have jurisdiction over any dispute arising from the VOW or these VOW Terms.
